We have had a few queries recently in regards to claiming loss of weekly earnings from the TAC. Here’s what you need to know:
- After the first 5 days off work you can claim loss of earning benefit payments due to time taken off work for treatment of transport-accident related injuries, you just need a medical certificate stating this and provide it to the TAC
- You can still claim if you return to work but at a later date need more time off to see doctors or specialists

A Bicycle Victoria member has had a traffic offence expunged after she asked us for help in challenging what she believed was an incorrectly imposed fine.
The rider had been trapped in a police exercise on April 12 directed at enforcing the rules regarding stopping at tram stops.
More than 100 riders were warned or fined for a number of offences on the day. The problem was that in many cases the offence no longer existed on the statute books.
Police have apologised and moved quickly to reverse the error, which was detected by the alert rider and followed up by Bicycle Victoria's riders rights officer and legal team at Maurice Blackburn. A printing error meant that Police were working from an out of date code book. The lesson here is that you should always check any documentation provided when the Police charge you with an offence. Make sure that the verbal advice an the written charge sheet are in accord, and that the offence you are charged with actually exists, and that the fine is the correct one. Check all dates, including the date by which the fine is to be paid.
